Mechanix Wear EMEA S.L.U. (“we”, “our”, “us”) understand the importance of your right to privacy and are committed to protecting and respecting your privacy. The Privacy Policy (“Policy”) sets out how we collect, use and disclose any personal data that individually identifies you in conjunction with your access, navigation, and use of our website and any services offered therein (“Service”).
This Policy complies with all applicable privacy legislation, including the General Data Protection Regulation (“GDPR”). Please read the following Policy carefully to understand our practices regarding your personal data.

1.0    Information We Collect & How We Use It
We may collect and use personal and non-personal data from you when you access or use the Service. In this section of the Policy, we will describe the type of information that may be collected and how that information may be used.

1.1     How the Collected Information is Used in the B2B Hub
Mechanix Wear EMEA S.L.U. has set up a dedicated hub for its commercial partners and distributors (“Hub”). While the majority of the information which would be made available through the Hub would relate to company names and contact information, the Hub may also include personal data which may be protected under various data protection law, including the EU and UK General Data Protection Regulation (“GDPR”). This may include names, professional addresses, professional phone numbers, professional email addresses and other information about an individual. Mechanix Wear EMEA S.L.U. may either collect such personal data directly from you, as an individual, or through its commercial partners and distributors. When you sign up to use the Hub, we may collect the information provided through the account sign-up feature and otherwise in respect of your activity on and use of the Hub and associate it with other personal information. We may make the professional information relating to our commercial partners and distributors available to our users of the Hub who access this information on our behalf. We use this information: (a) to provide the Hub; (b) to verify your identity and facilitate your access to and use of the Hub; (c) to provide you with support in relation to your use of the Hub; (d) to ensure the proper information of our commercial network; (e) to process your orders; (f) to better assist you when you visit or contact us in the future; (g) to evaluate our own products and make improvements to our products and/or services; (h) to improve our product offerings when we send you information about these in accordance with this Privacy Policy. 


1.2    Use of Data
We will only use your personal data when allowed by law. We will use your personal data: (a) where we need to perform the contract we are about to enter or have entered with you; (b) where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests; and (c) where we need to comply with a legal or regulatory obligation.

1.3    Contacting Us
When you choose to contact us through the Service, we may collect, store and use the personal data that you provide us, such as your name, email address, phone number and other information you choose to provide in the content of your message, so we can respond to your inquiry.
Contact Form: Should you send us questions or information via any of our Contact Forms, we will collect the data entered on the form, including the contact details you provide, to answer your question or queries and any follow-up questions. We do not share this information without your permission.
Communicating With You By Email: By providing your email address to us or communicating with us via email, you are deemed to expressly consent to receiving email communications from us in conjunction with the Service that we provide to you.
We use customerservice-emea@mechanix.com to send newsletter emails to users who subscribe to receive them. We use the data stored in the registration for the newsletter exclusively for our newsletter and do not pass this on without your permission.
When you open an email sent by policy-eu@mechanix.com, a file included in the email (called a web beacon) connects to insert’ servers in insert location. This allows us to determine if a newsletter message has been opened and which links you click on. In addition, technical information is collected (e.g. time of retrieval, IP address, browser type, and operating system). This information cannot be assigned to a specific recipient. It is used exclusively for the statistical analysis of our newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to your interests.
You can unsubscribe from our newsletter by finding the unsubscribe link at the bottom of our emails. If you unsubscribe, then we delete all data that was saved with the registration for the newsletter.


1.4    Non-Personal Information
For the purpose of this Policy, “non-personal data” means: (1) information that does not directly identify you; and (2) “aggregate” and “anonymized” information, which is data we collect about the use of the Service from which personal data has been removed.


1.5    Cookies & Tracking Data
We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. We treat information collected by cookies and similar technologies as 1non-personal information.
Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. The cookies that we use do not include personal data and may be used to: (1) help you navigate around the Service, (2) monitor how many people are using the Service, and (3) track trends. Once you leave the Service, the cookie is not retained on your computer. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

2.1    How/When the Collected Information is Disclosed
We will never sell, share, transfer or rent your personal information for secondary purposes.
In certain circumstances, we may share any or all information we have collected, including personal data. For example:

  • Your Personal Data may be transferred to anyone who is helping us make our website and the Service available and functional, like technical agents, other subcontractors, and our affiliates and consultants, subject to obligations consistent with this Fine Print;
  • If we are required to disclose or share your Personal Data under a legal obligation, in order to enforce or apply our contractual agreements or without your consent pursuant to any of the exceptions in the Acts; and
  • If we sell, merge, or transfer any part of our business, we may be required to share your information. 
  • Other than as set out above, we will provide you with notice and the opportunity to choose when your personal data may be shared with other third parties.

2.2    Data Processing
We may also disclose personal data to its service providers for the purpose of processing personal data on its behalf or assisting in the operation of the Service or our other products. We require that these parties agree to process such personal data based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.
International Data Transfers: The personal data you provide to us is being transmitted to us and processed in the United States and by our affiliates and their service providers in jurisdictions where we or they operate, and which may not offer the same level of data protection. Your personal data will be protected subject to this privacy policy and contracts that impose data protections as required by the country where your data was collected. Users are also given the opportunity to “opt-out” of having their personal data used for specific purposes, such as receiving newsletters or other information from us.
Withdrawals of consent will not have an effect on personal or other data that we have used or disclosed in accordance with this Policy prior to such withdrawals.

We may make available third party links through hyperlinks or otherwise enable you to access third party products or services from the Service that are not affiliated with or controlled by us. We are not responsible for those parties, the content of their products or services, or the use of information you provide to them. Providing links or otherwise enabling access to third party products or services does not constitute sponsorship of, or affiliation with those people or companies. You recognize and agree that we are not liable for any third parties use of your personal information and you should review the privacy policies of these third parties.


4.2    Data Storage
We take commercially reasonable steps as necessary to ensure that your data is treated securely in accordance with this Policy and applicable privacy legislation. However, please be aware that no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit on or through our website or the Service and you do so at your own risk. 


4.3    Information Security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of personal information. We use physical, electronic and/or procedural safeguards to protect its systems and all personal information under its control against unauthorized access and use.
We only use third party server hosts with certified facilities that contain the industry standard physical, operational, and digital security and restriction protocols. All safety and security measures are reasonable and appropriate to the sensitivity level of the information collected.

4.4    Retention of Personal Information
We retain personal information collected pursuant to this Policy only as long as is reasonably required to fulfill the purposes for which it was collected, or as required or authorized by law.


5.0    Rights Under EU/UK GDPR

Access, Correction or Deletion: You may request access to, correction of, or deletion of your personal data. You can often go directly into the Service under Account Settings to take these actions.

Please note that even if you request for your personal data to be deleted, certain aspects may be retained for us to: meet our legal or regulatory compliance (e.g. maintaining records of transactions you have made with us); exercise, establish or defend legal claims; and to protect against fraudulent or abusive activity on our Service. Data retained for these purposes will be handled as described in “Data Retention” subsection, below.

Objection: You may object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. Restriction. You have the right to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal data conducted in reliance on lawful processing grounds other than consent.

To file a request or take action on one of your rights, please contact us at the contact details provided. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

6.0    Changes to the Policy
We reserve the right to modify this Policy at any time. We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We may provide you with notice of such modifications, by sending you an e-mail message or otherwise bringing it to your attention in the Service. Your continued use of the Service will signify your acceptance of the modifications to this Policy. The Policy may be modified from time and time and you are advised to review the Policy periodically for any changes.
